SECTION 2
Using IRAC method discuss human rights violations in reference to the HRA 1998, ECHR 1950(limited to the sections and articles we have covered in the module) and cases. SECTION 2 QUESTION:
Daniel and Sally are a couple with a 2-year-old son. They have been together for about 5 years. They both work in the hospitality sector in Cornwall. Due to the current cost of living crisis, they struggle to make the ends meet. Daniel and his colleague Charli, who is also in a difficult financial situation, make a plan to steal money from the hotel they work for. The plan was to take money from their boss’s safe and then shout out as if they have seen someone jumping out of the window of their boss’s office and running into the street. They also planned to call the police. The plan went well, they took the money shouted ‘thief, thief is running help’ then called the police. By coincidence there were two young police officers patrolling right in front of the hotel at the time they shouted. They immediately attended to the scene and noticed someone who was actually running around the hotel. They shouted to make him stop, however it was Simon who was jogging with his airpods in his ears listening to Iron Maiden. Simon did not hear the police. The police officers were not properly trained, and they shot Simon dead, mistaken that he was running away from the police.
During the investigation Daniel and Charli’s plan was revealed, they were tried for burglary. It turned around that Daniel was an immigrant on a visa in the UK. Daniel received a letter of deportation from home office due to his participation in criminal activities. Sally and Daniel are upset because if this deportation goes ahead their family unit might break down and they might not raise their child together. Daniel was imprisoned in a deportation centre called Wallthick. On the day of deportation, a protest was arranged in front of the Wallthick. Sally also participated. It was a peaceful protest. Protesters were sitting in silence holding banners. The Wallthick detention centre was run by the home office up until 2017 when it was outsourced to a private company called Yaresh. Yaresh was not happy with the protest and decided to disperse the protesters with water cannons. The protesters told Yaresh that this is abuse of their rights however Yaresh responded that they are a private company, and they can do what they want because they are not bound by the Human Rights Act
