Assessment – Referencing and Bibliography Activity

There are two parts to this assignment: a referencing activity and a bibliography activity.

Referencing activity :

In the passage below, there are footnotes that contain NO REFERENCE (are empty) and footnotes that contain INCORRECT or INCOMPLETE references. Where you find empty footnotes, provide the appropriate reference in the footnote by conducting your own research to find the most directly fitting source. For footnotes that contain references with incomplete or incorrect citation, use your research skills to find the original source in order to provide the correct and complete citation. Follow OSCOLA guidelines for all citations.

Bibliography activity :

When the list of references is complete, please arrange the citations into a Bibliography.
This assessment is worth 20% of your mark for this module. One mark will be given per correct reference. One mark will be given per correct citation in your bibliography.

Please note that we are testing your attention to detail. You MUST follow OSCOLA accurately in both your footnotes and bibliography. This means that even small errors, such as a missing comma, may result in you not being awarded the mark for that reference or citation. PLEASE

PAY ATTENTION TO DETAIL.

The Agreement under the United Nations Convention on the Law of the Sea on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas beyond National Jurisdiction (BBNJ Agreement) was adopted on 19 June 2023 under the auspices of the United Nations,   and marks a historical milestone in international law.

The BBNJ Agreement addresses four main issues: i) Marine genetic resources, including the fair and equitable sharing of benefits;  ii) Measures such as area-based management tools, including marine protected areas;  iii) Environmental impact assessments;  and iv) Capacity-building and the transfer of marine technology.

It has been observed that the BBNJ Agreement comprises four treaties,  and resembles a multilateral environmental agreement (MEA) as ‘like MEAs, it is intended to be a dynamic agreement that evolves in response to new information and circumstances. Like MEAs, it establishes a variety of institutions to implement and elaborate its provisions, including a conference of the parties, a scientific and technical body, a clearing-house mechanism, an implementation and compliance committee, and a financial mechanism.’

In a similar vein to MEAs – and the UN Convention on the Law of the Sea 1982, the BBNJ Agreement creates a framework for States to cooperate.  Like most MEAs, the BBNJ Agreement also contains dispute settlement provision
